The Cherwell District Council (Off-Street Parking Places) (Pioneer Square, Bicester) (Amendment) Order 2026
Cherwell District Council (hereinafter referred to as “the Council”) in exercise of their powers under sections 32, 34, 35, and 35A and Part III of Schedule 9 of the Road Traffic Regulation Act 1984, (which said Act is hereinafter referred to as “the Act of 1984”) and the Traffic Management Act 2004 and all Guideline Orders and Regulations made under the Traffic Management Act 2004,and of all other enabling powers, after consultation with the Chief Officer of Police in accordance with Part III of Schedule 9 of the Act of 1984, with the Traffic Commissioners, in accordance with Part V of Schedule 9 of the Act of 1984, and with the consent of Oxfordshire County Council in accordance with Section 39(3) of the Act of 1984, hereby make the following Order:-
1. This Order may be cited as the Cherwell District Council (Off-Street Parking Places) (Pioneer Square, Bicester) (Amendment) Order 2026 and shall come into operation on [date to be inserted];
2. From and including the date specified in Article 1 of this Order, the Cherwell District Council (Off-Street Parking Places) (Banbury, Bicester and Kidlington) (No. 2) Order 2011 (as previously amended) (hereinafter referred to as “the Existing Order”) shall be read and construed as varied by the provisions set out in Article 4 of this Order;
3. Any words or expressions used in this Order shall have the same meaning as given to such words or expressions in the Existing Order except where stated to the contrary;
4(i) The schedule marked ‘Schedule 24’ appended to this Order shall be added to the Existing Order as a new schedule and the plan marked ‘Plan 24’ appended to this Order shall be added to the Existing Order as a new plan so as to bring the off-street parking place at Pioneer Square, Bicester within the regulatory provisions of the Existing Order.
4(ii) Article 3 to the Existing Order shall be amended to include the following definitions:
"hackney carriage” has the same meaning as defined in Section 38 of the Town and Police Clauses Act 1847
"private hire vehicle” has the same meaning as defined in Section 80 of the Local Government (Miscellaneous Provisions) Act 1976
"restricted area” means an area over which rights of access are allowed in connection with the use of premises neighbouring or adjoining a parking place and shown hatched blue on plans referred to in the Schedules to the Existing Order
4(iii) Article 5(4) to the Existing Order currently reads:
"(4) Notwithstanding the provisions of this Order, the Council reserve the right to grant upon such terms and conditions as they think fit rights of access across any of the parking places to which this Order applies for the purpose of obtaining rear access to premises adjoining such parking places, in which case the provisions of this Order shall apply to vehicles exercising such rights in accordance with the terms and conditions thereof.”
but will accordingly be amended to read as follows:
“(4) Notwithstanding the provisions of this Order, the Council reserves the right to allow persons upon such terms and conditions as the Council thinks fit, rights of access across any of the parking places to which this Order applies in connection with the use of premises neighbouring or adjoining such parking places in which case the provisions of this Order shall apply to vehicles exercising such rights in accordance with the terms and conditions thereof.
4(iv) Article 9 to the Existing Order shall be amended to include a new paragraph (10) to read as follows:
"(10) Where, within a parking place, there is a sign or surface marking which indicates that a parking bay is available only for use by hackney carriage or private hire vehicles for the picking up or setting down of passengers, the driver of a vehicle shall not permit it to ply for hire or wait in that parking bay unless it is a hackney carriage or private hire vehicle in service and picking up or setting down passengers”
4(v) Article 9 to the Existing Order shall be amended to include a new paragraph (11) to read as follows:
"(11) Where, within a parking place, there is a sign or surface marking which indicates that a parking bay is available only for use by vehicles for the purpose of loading or unloading goods or persons, the driver of a vehicle shall not permit it to wait in that parking bay unless it is a vehicle and goods or persons are being loaded or unloaded from such vehicle”
4(vi) Article 33(1) to the Existing Order shall be amended to include new paragraphs (o), (p) and (q) to read as follows:
“(o) in a parking bay available only for use by hackney carriage or private hire vehicles for the picking up or setting down of passengers in accordance with paragraph (10) of Article 9 and the vehicle so left is not a hackney carriage or private hire vehicle picking up or setting down passengers in that parking bay”
“(p) in a restricted area”
“(q) in a parking bay available only for use by vehicles for the purpose of loading or unloading goods or persons in accordance with paragraph (11) of Article 9 and the vehicle so left is not a vehicle actively loading or unloading goods or persons in that parking bay”
4(vii) Article 33(3) of the Existing Order currently reads
“33.(3) A penalty charge of seventy pounds (£70) shall be payable in respect of (b) to (n) above and payment shall be made to the Council within 28 days of the Penalty Charge Notice, such date being the date upon which the penalty charge was incurred. A discount of 50 per cent will apply should payment be made to the Council within 14 days of the date of the Penalty Charge Notice”
but will accordingly be amended to read as follows:

4(viii) The Existing Order shall be amended to include a new Article 41A to read as follows:
“41A. Any person using a parking place as a means of access to premises neighbouring or adjoining but not forming part of the parking place shall be deemed to be doing so by licence of the Council and not as of right.”
5. The Existing Order shall remain fully effective as varied by this Order and the terms of the Existing Order shall have effect as though the provisions contained in this Order had been contained in the Existing Order with effect from the date shown in Article 1 of this Order.
