Charges for waste and recycling containers - terms and conditions

Terms and conditions

1.1  These terms and conditions (“Terms”) set out the basis on which Cherwell District Council (“we”, “us”, “our”) may supply of household waste and recycling containers (“Containers”) to the customer (“you”, “your”).

1.2  These Terms do not apply to garden waste bins which are subject to separate terms and conditions.

1.3  By submitting a request for a Container and making payment, you agree to be bound by these Terms.

Charges and Payment

2.1  The current costs for the supply of Containers are published on our website (the “Charges”).

2.2  The Charges for the types and sizes of Containers will be reviewed and updated from time to time and published on our website.

2.3  Charges for Containers are covered by Section 46 of the Environmental Protection Act 1990. The Charge covers the costs associated with the provision, delivery and administration of Containers. The Charges do not include the collection and disposal of household waste.

2.4  Containers will not be provided until you have paid the Charge in full. Payment of the Charge can be made online or through our Customer Service team via a credit or debit card. We accept cash payments only in exceptional circumstances, and you must contact our Customer Service team, who will determine whether to accept a cash payment or not.

Ordering Containers

3.1  Requests for Containers must be made through the Council’s online request form or by contacting the Customer Service Centre.

3.2  Once payment has been received in full, delivery of the Container will be arranged in accordance with the delivery timescales published on the website.  We will use reasonable endeavours to deliver Containers within the published timeframe. However, delivery times are indicative only and exact delivery dates cannot be guaranteed.

3.3  Containers are available by delivery only. Residents are not permitted to collect Containers.

3.4  All Containers supplied remain the property of Cherwell District Council at all times, including after delivery to the property.

Replacement of Damaged, Lost or Stolen Containers

4.1  You are responsible for keeping Containers safe, clean and in good condition. It is recommended that you label Containers with your property address.

4.2  Replacement Containers for damaged, lost or stolen Containers will need to be reordered in line with clause 3 and you will be charged save for if clause 4.3 below applies.

4.3  A Container may be provided for free of the Charges if damage to a Container has been caused by the Council’s waste collection crew during delivery of the Container or the course of waste collection. Claims will need to be verified by the Council by either:

4.3.1  The incident being recorded by the Council’s collection crew; or

4.3.2  You submit a claim with supporting photographic or video footage evidence.

Cancelling the Request, Moving House and Refunds

5.1  Our Contact Points

5.2  Cancellation of order

5.2.1  You can cancel your order by contacting the Council using the details in clause 5.1 above. Once your order has been cancelled, your Container must be returned and will be collected by the Council.

5.2.2  If you cancel your request within 14 days of payment, you will be refunded following return of the Container issued to you.

5.2.3  Any cancellations received outside of the 14-day period as detailed in clause 5.2.2 will not be eligible for a refund.

5.3  Moving House

5.3.1  Any Containers requested under these Terms must remain at the property they were requested for. Containers must not be transferred to a new address.

5.4  Removal of Containers

5.4.1  If a Container is no longer required, you can contact the Council by using the details in clause 5.1 above. We will arrange collection of the Container.

Liability

6.1  We accept no liability for any damages, loss, costs or expenses incurred by you arising under or in connection with the service other than liability that cannot be excluded by law. Our liability for death or personal injury caused by our negligence is not excluded.

Your Legal Rights

7.1  Nothing in these terms and conditions affects your rights in law.

Personal data

8.1  We will hold and process your personal data to complete the order of any Containers. By placing an order, you are also giving us permission to process your personal data. We will ensure that we comply with the Data Protection Act 2018 and the General Data Protection Regulation in processing your personal data. More information about how we use your personal data can be found in our privacy policy and privacy notice on our website.

8.2  You must inform us of any changes to your personal data.

Complaints

9.1  Complaints can be made via our *Complaints page* on our website or by writing to Us. The Local Government and Social Care Ombudsman may consider some complaints, please refer to the Ombudsman’s website.

Changes to These Terms

10.1      We will publicise all changes to these terms and conditions on our website.
